Personal Data Notice issued under the Personal Data Protection Act 2010 (Malaysia)

At Jiham Creatives Sdn. Bhd. ("Jiham", "we", "us"), we respect your privacy and are committed to protecting your personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.

1. Personal Data We Collect

We collect only what we need to serve you:

• Contact and delivery details — your name, phone number, WhatsApp number, email address, delivery and billing address;
• Order details — the artwork, text, names, dates or verses you ask us to produce, your room or wall photographs, measurements, and your order and payment history;
• Enquiry details — information you give us in a lead or enquiry form, such as your location and the type of space you wish to decorate;
• Website activity — see Advertising & Analytics below.

We do not ask for and do not require your identity card number, passport number, race, religion, marital status, income, or details of your children or family members. Please do not send us these. If you send them to us anyway, we may delete them.

2. Purposes of Processing

We process your personal data to:

• Prepare quotations, confirm designs, fulfil your orders, arrange delivery and installation, and process payments and refunds;
• Respond to your enquiries and provide customer support and after-sales service;
• Carry out our own internal marketing and promotional activities — sending you offers, catalogues, new-design announcements and promotional messages about Jiham's own products and services, by WhatsApp, SMS, email or telephone;
• Keep internal records, train our staff, assure service quality, and carry out research and statistical analysis;
• Comply with Malaysian law and respond to lawful requests from regulators, courts and enforcement agencies.

Promotional messages are sent by Jiham, about Jiham's own products and services only. We do not send you marketing on behalf of other businesses. You may opt out at any time — see Your Rights below — and doing so will not affect any order you have already placed.

3. Disclosure to Third Parties

Your personal data is kept confidential. We disclose it only to the following classes of third party, and only so far as needed to serve you:

• Courier and logistics partners — to deliver your item;
• Payment service providers — Stripe (cards and e-wallets), BCL (FPX online banking) and Atome (instalment payments) to process your payment. Where you choose an instalment plan, Atome is a separate credit provider and will process your data under its own privacy policy and credit assessment;
• Installation contractors and artisans engaged by us — to produce and install your artwork at your premises;
• Communication and IT service providers — including our WhatsApp Business provider, email provider and hosting provider;
• Professional advisers, regulators and enforcement agencies — where required by law.

We do not sell, rent or trade your personal data to external marketers.

4. Advertising & Analytics

Our websites use analytics and advertising tools, including Google Analytics, the Meta Pixel and the TikTok Pixel. These set cookies and identifiers in your browser and share website activity with those providers so we can measure and target our advertising. This is separate from the contact details you type into a form. You can block these through your browser settings or device ad-tracking controls.

5. Is Supplying Your Data Obligatory?

Supplying your name, contact number and delivery address is obligatory — without them we cannot accept, produce, deliver or install an order. Everything else is voluntary. If you do not supply the obligatory data, we will not be able to proceed with your order or enquiry.

6. Retention

We keep your personal data only for as long as it is needed for the purposes above. Order and payment records are kept for seven (7) years to meet Malaysian tax and accounting requirements. Marketing contact details are kept until you opt out. Enquiry records for enquiries that do not become orders are kept for twenty-four (24) months. After that, data is deleted or anonymised.

7. Data Security

We implement appropriate administrative, technical and physical safeguards to protect your data against unauthorised access, alteration or loss. No system is perfectly secure, and we cannot guarantee the security of information you send us over the internet or messaging apps.

8. Your Rights

Under the PDPA you have the right to:

• Request access to the personal data we hold about you;
• Request correction of data that is inaccurate, incomplete, misleading or out of date;
• Withdraw your consent to our processing of your personal data;
• Require us to stop processing your data for direct marketing at any time (section 43, PDPA 2010);
• Limit the processing of your data for particular purposes.

To exercise any of these rights — including asking us to remove your phone number or email from our marketing list — contact salam@jiham.my or +60 3-8691 8711. You do not need to give a reason. There is no charge for a marketing opt-out. We will action marketing opt-outs immediately on receipt and respond to access or correction requests within twenty-one (21) days. We may need to verify your identity before releasing data. Where we must keep certain records by law (for example tax records), we will tell you.

This website is operated by Jiham Creatives Sdn. Bhd., trading as JIHAM Kaligrafi. Throughout the site, "we", "us" and "our" refer to Jiham Creatives Sdn. Bhd. By visiting our site, placing an order, paying a deposit, or approving a design, you engage in our Service and agree to be bound by these Terms of Service, including the policies referenced in them. If you do not agree, you may not use the Service.

1. Online Store Terms

By agreeing to these Terms you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any unlawful purpose, nor violate any laws in your jurisdiction (including copyright laws). You must not transmit any worms, viruses or code of a destructive nature. A breach of these Terms results in immediate termination of your Service.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding payment card information) may be transferred unencrypted over various networks. Payment card information is always encrypted in transit. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, our artworks, or our designs without our express written permission.

3. Artistic Licence & Product Variations

Our products are handcrafted. By purchasing, you acknowledge that:

• Wood grain: natural wood may vary in grain, knots, colour and texture. These are natural characteristics, not defects.
• Handwriting: as our calligraphy is hand-written or hand-designed, slight variations in strokes or layout compared with digital mockups may occur. We reserve the right of artistic interpretation in the final output.
• Colour and dimensions: we make every effort to display colours and images accurately, but screens vary and slight variations in frame texture, printing and dimensions may occur. We cannot guarantee your screen's colour rendering matches the finished physical artwork.

4. Design Approval & Customer Errors

For custom work, all specifications must be confirmed by you in writing before production begins. The design proof you approve is final. We are not responsible for typographical or spelling errors, wrong names, wrong dates or wrong verses where the text was produced exactly as you submitted or approved it. Please check your proof carefully before approving and paying. Once production has started, modifications and cancellations cannot be accommodated.

5. Calligraphy Accuracy & AI-Generated Visuals

To help you visualise our art in various spaces, we use Artificial Intelligence to generate room mockups, interior concepts and layout inspirations.

• Conceptual layouts only: these digital mockups are strictly for visual inspiration and conceptualisation.
• AI calligraphy limitations: AI tools frequently produce inaccuracies or structural errors when rendering Arabic text and traditional Islamic calligraphy. Text visible in our AI-generated concept images does not represent our actual work and must not be read as accurate calligraphy.
• Commitment to authenticity: all final physical artworks are meticulously crafted by qualified calligraphers, referenced against a Mushaf Al-Quran certified by KDN, and human-verified before release.

6. Intellectual Property

All designs, artwork and content produced by Jiham Creatives Sdn. Bhd. remain our intellectual property. Purchasing a physical piece does not grant you the right to reproduce, scan, digitise, or resell the design for commercial purposes without our written consent.

7. Accuracy of Information, Prices and Modifications

We are not responsible if information on this site is not accurate, complete or current; the material is provided for general information only. Prices are subject to change without notice, and we may modify or discontinue the Service or any product at any time without notice and without liability to you or any third party.

8. Errors, Inaccuracies and Omissions

Occasionally our site may contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions or availability. We reserve the right to correct such errors and to change, update or cancel an affected order at any time without prior notice. If we cancel an order for this reason, we will refund you in full.

9. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us, and to limit or cancel quantities purchased per person, per household or per order. You agree to provide current, complete and accurate purchase and account information for all purchases.

10. Optional Tools & Third-Party Links

We may provide access to third-party tools over which we neither monitor nor have control, and we have no liability arising from your use of them. Certain content, products and services available via our Service may include materials from third parties; we are not responsible for examining or evaluating third-party websites or their accuracy.

11. User Comments, Feedback and Submissions

If you send creative ideas, suggestions, proposals or other materials ("comments"), you agree that we may at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use them in any medium. You agree that your comments will not violate any right of any third party, including copyright or trademark.

12. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy.

13. Prohibited Uses

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in unlawful acts; (c) to violate any regulations, rules, laws or local ordinances; (d) to infringe our intellectual property rights or those of others; (e) to submit false or misleading information; (f) to upload malicious code.

14. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the Service is at your sole risk. To the fullest extent permitted by Malaysian law, Jiham Creatives Sdn. Bhd., its directors, officers, employees and affiliates shall not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of the Service or any products procured using it. Our maximum aggregate liability for any claim shall not exceed the purchase price actually paid by you for the product or service giving rise to the claim. Nothing in these Terms excludes any liability that cannot be excluded under Malaysian law, including under the Consumer Protection Act 1999.

15. Indemnification

You agree to indemnify, defend and hold harmless Jiham Creatives Sdn. Bhd. and our affiliates, partners, officers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms of Service.

16. Severability & Termination

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the remaining provisions are unaffected. These Terms are effective unless and until terminated by either you or us.

17. Entire Agreement & Governing Law

These Terms of Service, together with the policies posted by us, constitute the entire agreement between you and us. They are governed by and construed in accordance with the laws of Malaysia, and disputes are subject to the exclusive jurisdiction of the courts of Malaysia.

18. Changes to These Terms

We may update these policies from time to time by posting the revised version. The version in force at the time you place your order is the version that applies to that order. It is your responsibility to check this page periodically.

Important — Custom Orders. Substantially all of our artwork is made to order. Once a custom or personalised order (any item bearing a specific name, date, verse, size or design you selected) has proceeded to the production stage, it cannot be cancelled, returned, refunded or exchanged. Production begins after you approve the design proof and payment is received.

1. Cancellation Before Production

You may cancel an order at no charge at any time before you approve the final design proof. Once we have begun production, the clause above applies.

2. Non-Returnable Items

The following cannot be returned or exchanged:

• Custom, personalised or made-to-order artwork;
• Items on sale, clearance or bought with a promotional discount;
• Gift cards and vouchers;
• Items damaged after delivery, after installation, or after self-pickup has left our premises.

3. Ready-Made Stock Items

Where an item is a ready-made stock design and is not personalised, you may request a return within seven (7) days of receipt. The item must be unused, in its original condition and original packaging, with proof of purchase. Return postage is borne by you unless the item was faulty or wrongly supplied. Contact salam@jiham.my before sending anything back — items returned without an approved return request will not be accepted.

4. Damaged in Transit — 1-to-1 Replacement

We insure our parcels. If your artwork arrives cracked, broken or damaged, we will replace it 1-to-1 at no additional cost, provided you follow these steps:

• Do not discard the box, bubble wrap or any packaging;
• Take clear photographs of the damage and of the external packaging;
• WhatsApp or email us within forty-eight (48) hours of receipt.

The 48-hour window exists because couriers reject damage claims filed later. If you report after 48 hours we may be unable to recover from the courier, and we may not be able to offer a free replacement. Please inspect your parcel on arrival.

5. Wrong or Defective Item

If we supply the wrong item, or an item with a manufacturing defect, notify us within seven (7) days of receipt with photographs. We will repair, replace or refund it at our option, at our cost.

6. How Refunds Are Paid

Approved refunds are paid to your original payment method within fourteen (14) working days of approval. Your bank, card issuer or instalment provider may take additional time to post the credit. Where you paid by instalment, the refund is processed through that provider under its own terms.

1. Production Time and Delivery Time Are Separate

Your total waiting time is production time plus delivery time. These run one after the other, not at the same time.

The production clock starts on the later of: (a) the date we receive your payment or deposit in full, and (b) the date you approve the final design proof. Delays in approving your proof extend the timeline accordingly.

All timeframes above are good-faith estimates, not guarantees, and exclude weekends and Malaysian public holidays. Peak seasons (Ramadan, Syawal, year-end) may extend them. We will keep you updated on the progress of your order and send you a tracking number as soon as it is dispatched.

2. Force Majeure

We are not liable for delays caused by events beyond our reasonable control, including natural disasters and floods, courier disruption or strikes, public holidays, utility or supply-chain failures, or acts of government.

3. International Shipping

We ship internationally. Contact us at +60 3-8691 8711 for a quotation. Any customs duties, import taxes and clearance charges are borne by you.

4. Unclaimed Parcels & Incorrect Addresses

If a parcel is returned to us because it was unclaimed or because you supplied an incorrect or incomplete address, you bear the cost of re-shipping.

5. Installation Service

• Installation covers Peninsular Malaysia, with priority given to the Klang Valley, Putrajaya and Negeri Sembilan. Check coverage at installation.jiham.my.
• We install only on walls not exceeding 10 feet (approx. 3 metres) in height.
• Once your product is ready we will contact you by WhatsApp to arrange an appointment. We accommodate up to three (3) appointment changes; further changes may incur a re-scheduling charge.
• Where your building management (JMB/MC) requires prior approval or a permit for drilling or contractor access, obtaining it is your responsibility. We are happy to supply documents to assist. Appointments missed because approval was not in place count towards your three changes.
• Additional drill holes outside the scope of the product installation are charged at RM15 per hole, payable directly to the installer.
• You are responsible for telling us about concealed wiring, plumbing or structural conditions behind the wall. We are not liable for damage to concealed services that were not disclosed to us.
• We do not install, and are not liable for damage to, products not supplied by Jiham.

6. Self-Pickup

• Available on working days, 9:00am–12:30pm and 2:15pm–5:45pm. Please call +60 3-8691 8711 to confirm your appointment before coming.
• You may collect on behalf of another buyer; give us the order details and the buyer's name in advance, and we will confirm with the buyer before releasing the item.
• Please inspect your item fully before leaving our premises. Damage occurring after the item leaves our premises is not covered.
